Lawsuit Against Mercy Health Lorain Hospital

On December 10, 2021, WVFk&N attorneys Mary Koch and Sarah Smith filed a medical malpractice claim on behalf of a newborn who suffered an avoidable brain injury.

The complaint alleges that the child’s mother presented to Mercy Health Lorain Hospital complaining of contractions in January of 2021 at 39 weeks and 4 days’ gestation. The mother experienced a uterine rupture approximately one hour before the baby was delivered which resulted in a deprivation of oxygen to her child. The baby suffered a hypoxic ischemic injury to his brain, which led to a nine month stay in the NICU. The baby has been diagnosed with spastic quadriplegic cerebral palsy.

The lawsuit alleges that the injuries were a result of the negligence of Mercy Health Lorain Hospital and its employees in failing to timely respond to concerning clinical signs and failing to timely deliver the baby.

The action is pending in the Court of Common Pleas for Lorain County, Ohio.
