European Girl Settles Case with Hospital for 198K Euro for Delivery Error

Earlier last month in Ireland, a young girl and her family settled a malpractice suit with the hospital that delivered the girl. According to a report by one local news source, the girl suffered cuts to her face and eye as a result of improper and incompetent use of surgical forceps during the birthing procedure.

She uses glasses on a daily basis, but doctors say that she should be able to stop using them soon. When she was born, however, her right eye was cloudy after the junior doctor assisting with her birth scratched her eye with the forceps. Her face also had a number of cuts on it from the wounds caused by the forceps. She also has a small scar under her right eye.

Birth Injuries in the United States and Medical Malpractice Actions
Medical care in the United States is comparable to medical care elsewhere in the western world. And the fact of the matter is that doctors–like everyone else–make mistakes on occasion. When doctors do make mistakes, they can be held liable for their actions through medical malpractice actions.

A medical malpractice action is basically a claim of medical negligence. Essentially, a medical malpractice plaintiff is claiming that the treating physician was in some way negligent and that his or her negligence caused some harm to the plaintiff (or to a plaintiff’s loved one, in the case of a wrongful death suit).

In order to show that a physician was medically negligent, the plaintiff will need to go through an established process by which the physician’s conduct is compared to other physicians in the same field and with a similar amount of training. In this way, medical malpractice suits differ from traditional negligence suits that do not require a plaintiff to take the defendant’s training into account.

When it comes to serious and preventable birth injuries, there are few more tragic or high-stakes claims. Often, a birth injury will affect not just the child, but also the parents and the rest of the family as well. These cases are certainly some of the more emotional and difficult cases to handle. Therefore, it is advised that you consult with a dedicated birth injury attorney before beginning the process, in order to familiarize yourself with what to expect as you move forward.

Have You Recently Suffered through a Birth Injury?

If you or your loved one has recently had a child injured during the birthing procedure, and you believe that it was due to the negligence of one of the attending physicians, you may be entitled to monetary damages to help compensate you for your loss. Depending on the type of claim, and what the damages are, the suit may be brought in either the injured child’s name or in the parents’ name. Either way, a birth injury suit is one way to hold the responsible party accountable for the injuries to your child.
