Ophthalmology Malpractice

Last week a Baltimore County jury awarded $1 million dollars in a medical malpractice claim alleging that the Plaintiff had lost nearly all her vision under the Defendant ophthalmologist’s care. This is a great result in what is considered to be a difficult venue for malpractice claims.

What makes the case even more interesting is that it was was filed all the way back in the beginning of 2005. The case was originally filed in the Circuit Court for Baltimore City. It was moved to Baltimore County after a Baltimore City judge determined that venue was appropriate in Baltimore County, not Baltimore City. After that ruling, the case was appealed and the transfer to Baltimore County was affirmed. The case was re-filed on July 28, 2010.

This is a great example of persevering and continuing to seek justice for an injured plaintiff. Unfortunately, it appears as though the verdict is going to be reduced by the cap on non-economic damages to $620,000.00.
